SITUATION
The land is situated in the village of Brigsteer with access off Low Lane and Brigsteer Causeway.
The land is to be offered for sale in three lots, one lot having the benefit of planning permission for the erection of a 60’ x 30’ agricultural storage building.
Lot 1 (as edged red on the plan)
3.76 acres/1.52 hectares of fertile meadow and with access off Low Lane/Brigsteer Causeway, with a natural water supply, being O.S. No. SD4789 9923 and with approval for a building as detailed below under Planning.
Lot 2 (as edged green on the plan)
4.05 acres/1.64 hectares of productive meadow land with a natural water supply, being O.S. No. SD4789 9733
Access to this land is via a right of way off Low Lane, indicated with a broken green line.
Lot 3 (as edged orange on the plan)
4.72 acres/1.91 hectares of useful pasture land, with access directly off Low Lane and with a natural water supply, being O.S. No. SD4789 9646.
PLANNING
Attached to these particulars is a copy of a letter from South Lakeland District Council dated 11th April, 2008 under which the Council Planning Officer states that they have no objection to the erection of an animal feed site and agricultural storage building. The building design is a steel portal framed building, clad on all sides and the roof with box profile sheeting and with a door to the West elevation. This was designed to be erected on part of Lot 1 but the work has not been carried out. In accordance with the letter, the work will have to be carried out before April, 2011.
SINGLE PAYMENT SCHEME
The land is registered for Non SDA Entitlements under the Single Payment Scheme. The 2008 value was €141.93 or £122.17 before modulation. This will probably rise over the years to 2012.
The Entitlements for 2010 onwards will be transferred to the purchasers as part of the purchase price but the sellers have made an application for the 2009 payment and will retain the same.
The RLE1 transfer forms will be completed and submitted by M.B. Hodgson & Sons for which the transferee/purchaser of each lot will pay a fee of £75 plus VAT.
TENURE
The property is freehold and vacant possession will be given on completion.
METHOD AND ORDER OF SALE
The vendors reserve the right to alter the order of sale, amalgamate, withdraw or sub-divide any of the lots up to and including the time of the sale.

The Contracts and Conditions of Sale under which we are to offer the property for sale will NOT be read out on the auction day but will be available for inspection at the offices of the Auctioneers and Solicitors from Monday, 24th August, 2009. Any intending purchasers should take the opportunity to read these documents as the sale will be held subject to the same. Any purchaser will be deemed to have bought subject to the same whether, in fact, he/she has read them or not.
